I do hereby voluntarily and expressly grant to SIMAS & ASSOCIATES, LTD., as well as its respective affiliates, assigns, partnerships, joint ventures, and heirs (collectively referred to as “Releasees”) the absolute and irrevocable right and permission to use my name (or any fictional name), contact information (including address, email address, and telephone number), photograph (including composite or distorted representations), recorded voice, motion picture (of my person captured, in whole or in part), factual information about the representation and results (including date hired, matter(s) represented, results of adjudication, results of settlement), and/or written statement, (collectively referred to as “Released Subject Matter”) for advertising, public relations, trade, or any other lawful purposes. To that end, I hereby forever expressly waive, release and relinquish all my rights, title and interest in the Released Subject Matter to Releasees.
I hereby further grant to Releasees worldwide rights in perpetuity for the Released Subject Matter to be utilized in all media and communication vehicles including without limitation television, cable, satellite, radio, satellite radio, print, internet advertising, downloads, blogs, social media, brochures, pamphlets, flyers, leaflets, and public relation purposes, as well as all forms of media now known or later invented (collectively referred to as “Media”) for the purposes set for herein. I hereby waive any right to inspect or approve the finished version(s), including written copy that may be created and appear in connection therewith.
I hereby understand that I am not being paid any compensation for the use of the Released Subject Matter now or at anytime in the future.
I hereby forever waive to the fullest extent that the law permits, any causes of action in law or equity I may have or may hereafter acquire against the Releasees or any of them for libel, slander, invasion of privacy, copyright infringement, trademark violation, right of publicity, or false light arising out of or in connection with the use of the Released Subject Matter by the Releasees.
I hereby understand that in the event that any term of this Release is held by a court or tribunal of competent jurisdiction to be unenforceable, the unenforceable term or provision shall be stricken from this Release, and the remaining provisions shall remain in full force and effect.
I hereby agree that any dispute related to this Release, the contents described herein, or the use of the Release Subject Matter shall be governed and construed in accordance with the laws of the State of California and that jurisdiction shall be the state of California with venue in Sacramento County.
I hereby agree that this Release represents the entire understanding and agreement between the Releasees and the undersigned with respect to the Released Subject Matter and may not be modified except by a writing signed by the Releasees and the undersigned.
