Recently, Simas & Associates successfully represented a California veterinarian in a petition brought by the California Veterinary Medical Board seeking to revoke probation and impose additional discipline. After a multi-day administrative hearing, the Administrative Law Judge dismissed the petition in its entirety and ordered that the veterinarian’s probation be terminated. The Board adopted that decision as its final order.

The case illustrates an important principle that extends well beyond veterinary medicine: technical probation violations should always be evaluated within the full context of a professional’s conduct, good faith efforts, and commitment to serving the public.

The allegations centered on several technical probation issues, including late reports, delayed monitoring payments, employer notification forms, supervision reports, and approval requirements for continuing education. Importantly, the evidence also showed that our client ultimately completed the required education, became current on all monitoring costs, maintained employment, and addressed every outstanding probation requirement.

Administrative agencies certainly have an obligation to enforce probation conditions. At the same time, disciplinary proceedings are not intended to punish professionals for every procedural misstep without considering the surrounding circumstances.

Instead, the judge determined that further punishment would be unduly punitive and ordered that the petition be dismissed and probation terminated. The California Veterinary Medical Board later adopted that proposed decision as its final decision.

This outcome reflects a fundamental principle of California professional licensing law: disciplinary proceedings exist to protect the public, not to impose unnecessary punishment when the evidence shows rehabilitation, compliance, and continued safe practice.
